Creator Agreement

The Makeup Fetish Creator Program allows approved creators to monetize their presence on the Platform through multiple revenue streams: product sales through your personal shop, affiliate commissions on products you recommend, tips and donations from followers, and paid content (courses, tutorials, exclusive looks).

This Agreement outlines the terms of your participation, including revenue sharing, content ownership, payout terms, and your obligations as a creator on the Platform.

2.1 Requirements. To join the Creator Program, you must:

• Be at least 18 years old
• Have a Makeup Fetish account in good standing
• Have at least 5 published looks or tutorials
• Complete identity verification
• Provide valid tax information (W-9 for US creators, W-8BEN for international)
• Have a verified payment method for receiving payouts

2.2 Application Review. Applications are reviewed within 48 hours. We may request additional information or samples of your work. Acceptance is at our sole discretion.

2.3 Ongoing Compliance. Creator status is subject to ongoing compliance with this Agreement. We may revoke creator status for violations.

3.1 Creator Share. You receive 80% of net revenue from all sales made through your creator shop. Net revenue is defined as the sale price minus applicable taxes, shipping costs, payment processing fees (approximately 2.9% + $0.30 per transaction), and any refunds or chargebacks.

3.2 Platform Share. Makeup Fetish retains 20% of net revenue as a platform fee. This covers payment processing infrastructure, hosting, customer support, marketing, and platform maintenance.

3.3 Tips and Donations. You receive 90% of tips and donations from followers. The 10% platform fee covers payment processing and platform costs.

3.4 Paid Content. Revenue from paid courses, tutorials, and exclusive content follows the standard 80/20 split.

4.1 Commission Rate. Creators earn a 15% commission on all qualifying purchases made through their affiliate links. This includes products from any brand or seller on the Platform.

4.2 Attribution Window. Affiliate links have a 30-day cookie window. If a user clicks your link and makes a purchase within 30 days, you earn the commission, even if they navigate away and return later.

4.3 Qualifying Purchases. Commissions apply to all products purchased through your link, not just the specific product linked. Gift cards, subscription services, and platform fees are excluded from commission calculations.

4.4 Disclosure. You must disclose affiliate relationships in compliance with FTC guidelines. Use our built-in disclosure tools or include #affiliate or #ad in your content.

4.5 Prohibited Practices. Self-purchasing through your own affiliate links, incentivizing clicks without genuine content, and cookie stuffing are prohibited and will result in commission forfeiture and possible account termination.

5.1 Minimum Threshold. Payouts are available once your balance reaches the minimum threshold of $25.00 USD. Balances below this amount carry over to the next period.

5.2 Processing Time. Payout requests are processed within 2-5 business days. Processing times may vary based on your payment method and financial institution.

5.3 Payment Methods. We support the following payout methods:

• Direct deposit (ACH) - US bank accounts only, 2-3 business days
• PayPal - worldwide, 1-2 business days
• Stripe Connect - worldwide, 2-5 business days
• Wire transfer - for balances over $1,000, 3-5 business days (fees apply)

5.4 Holds and Reserves. We may place temporary holds on payouts for new accounts (first 30 days), disputed transactions, or suspected fraudulent activity. We will notify you of any holds and the reason.

5.5 Taxes. You are solely responsible for reporting and paying all applicable taxes on your earnings. We will issue 1099 forms (US) or equivalent documentation as required by law for earnings exceeding applicable thresholds.

5.6 Currency. All earnings are calculated and displayed in USD. International payouts may be subject to currency conversion fees charged by your payment provider.

6.1 Your Intellectual Property. You retain full ownership of all original content you create and post on the Platform. This includes looks, tutorials, photos, videos, written content, and any original creative works.

6.2 Platform License. By posting content, you grant Makeup Fetish a non-exclusive, worldwide, royalty-free license to display, distribute, reproduce, and promote your content within the Platform and in marketing materials. This license terminates when you delete your content, except for cached or archived copies.

6.3 Promotional Use. We may feature your content in promotional materials, social media, newsletters, and press releases. We will credit you by your username when featuring your work. You may opt out of promotional use in your Creator Studio settings.

6.4 No Exclusivity. This Agreement does not require exclusivity. You are free to post content on other platforms, work with other brands, and maintain presences elsewhere. However, content posted on Makeup Fetish must not violate other platform agreements you hold.

6.5 Post-Termination. Upon termination of your creator account, your content will be removed from the Platform within 30 days unless you choose to maintain a standard (non-creator) account. Any paid content that users have already purchased will remain accessible to those users.

7.1 Quality Standards. Creators are expected to maintain high-quality content that provides genuine value to the community. This includes clear imagery/video, accurate product information, and honest reviews.

7.2 Authenticity. All reviews and recommendations must be genuine and based on your actual experience. You must clearly distinguish between products you purchased yourself and products you received for free or as gifts.

7.3 Safety. Never promote unsafe beauty practices, unregulated products, or techniques that could harm users. If demonstrating advanced techniques (e.g., chemical peels, microneedling), include appropriate safety warnings.

7.4 Responsiveness. Respond to customer inquiries about products you sell within 48 hours. Maintain accurate inventory and shipping information for your shop.

7.5 Community Conduct. Creators are community leaders. Engage respectfully, support other creators, and foster a positive environment. Harassment, discrimination, or toxic behavior will result in immediate review of your creator status.

7.6 Compliance. You must comply with all applicable laws and regulations, including FTC endorsement guidelines, FDA cosmetic regulations, and local business licensing requirements.

8.1 Creator Studio. You have access to Creator Studio, our analytics dashboard providing real-time data on views, engagement, follower growth, revenue, and affiliate performance.

8.2 Earnings Reports. Detailed earnings reports are available in your Creator Studio, broken down by revenue source, product, and time period. Monthly summaries are emailed on the first of each month.

8.3 Data Accuracy. We strive for accurate reporting but cannot guarantee real-time precision. Final revenue calculations may differ slightly from real-time estimates due to refunds, chargebacks, and payment processing adjustments.

9.1 Voluntary Termination. You may leave the Creator Program at any time by submitting a request in your Creator Studio settings. You will retain access to your creator features for 30 days to wind down operations and fulfill outstanding orders.

9.2 Involuntary Termination. We may terminate your participation in the Creator Program for:

• Violation of this Agreement, our Terms of Service, or Community Guidelines
• Fraudulent activity, including fake reviews, engagement manipulation, or affiliate abuse
• Selling counterfeit, unsafe, or prohibited products
• Extended inactivity (no posts or sales for 12+ months)
• Legal or regulatory requirements

9.3 Effect on Earnings. Upon termination, we will process a final payout of all legitimate, undisputed earnings within 30 days, regardless of whether the balance meets the minimum threshold. Earnings associated with fraudulent activity are forfeited.

9.4 Account Closure. Termination from the Creator Program does not automatically close your Makeup Fetish account. You may continue using the Platform as a standard user. If you wish to close your account entirely, you may do so through your account settings.

9.5 Appeal. If your creator status is revoked, you may appeal the decision within 14 days by contacting [email protected]. Appeals are reviewed within 7 business days.
